Terms & Conditions
These Terms govern the use of BigGuruAI, an AI-based learning platform operated by Durva AI Private Limited. By enrolling students on the platform, by logging in, or by adding funds to a BigGuruAI wallet, you accept these Terms. Please read them before you begin.
1. Definitions
- "We", "us", "our", "the Company" means Durva AI Private Limited, having its registered office at B-19, Sainik Colony, Near Jhajhria Hospital, Rajgarh (Sadulpur), District Churu, Rajasthan — 331023, India.
- "Platform" means the BigGuruAI website at bigguruai.com and the application at app.bigguruai.com, together with all features within them.
- "Institute" means a school, coaching institute or other educational organisation that has been onboarded by us and enrols students on the Platform.
- "Student" means a learner enrolled on the Platform, whether by an Institute or directly by us.
- "Parent" means the parent or lawful guardian whose mobile number is enrolled against a Student.
- "Wallet" means the prepaid balance maintained by us for an Institute or an independent Student, from which usage charges are deducted.
2. Nature of the service
BigGuruAI is a learning-support tool for NEET and JEE preparation. It generates explanations, practice tests and study plans using artificial intelligence, and it provides progress dashboards to Students, Parents and Institutes.
BigGuruAI is not a coaching institute, not a school, not an examination body, and not a substitute for a qualified teacher. It supplements teaching; it does not replace it.
3. Eligibility and access
- The Platform is not open to the general public. Access is granted only to mobile numbers enrolled by an Institute or by us. There is no self-service registration.
- Where a Student is below eighteen years of age, use of the Platform requires the consent of a Parent or lawful guardian. An Institute that submits a student list to us thereby confirms that it has obtained that consent.
- Login is by one-time password sent to the registered mobile number. You are responsible for keeping your mobile device and one-time passwords secure, and for all activity that takes place under your login.
- A single mobile number can hold only one role on the Platform. A number already registered as an Institute's appointed teacher cannot simultaneously be used as a Student or Parent number, and vice versa.
- Each Institute appoints one teacher or staff member whose mobile number may access the Institute dashboard. The Institute is responsible for whom it appoints and for informing us promptly if that person leaves.
4. Responsibilities of the Institute
- To submit accurate student and parent mobile numbers, and to keep that list current.
- To have obtained parental consent before submitting a child's details to us, and to be able to demonstrate that consent if asked.
- To inform us promptly when a student leaves, so that the account can be deactivated and charges stop.
- To maintain sufficient Wallet balance for its students to continue using the Platform.
- Not to resell, sublicense or provide access to the Platform to any person or organisation outside its own enrolled students, unless a separate written agreement with us permits it.
5. Acceptable use
You agree not to:
- use the Platform for anything other than bona fide educational purposes;
- share login access with anyone other than the person it was issued to, or use another person's account;
- submit unlawful, abusive, obscene, defamatory or infringing content, or content that is not related to study;
- attempt to gain unauthorised access to the Platform, its database or its infrastructure, or to probe, scan or test its security;
- use automated means to extract content, generate questions in bulk, or place unreasonable load on the Platform;
- copy, reproduce or redistribute content generated on the Platform for commercial sale, or represent it as your own product; or
- reverse engineer, decompile or attempt to derive the source code of the Platform.
We may suspend or terminate access immediately, without refund of consumed usage, where we reasonably believe these rules have been broken.
6. Artificial intelligence — important limitations
We make no representation that use of the Platform will produce any particular examination result, rank, score or admission. Academic outcomes depend on many factors outside our control.
7. Wellness features are not medical services
The Platform includes a mood check-in feature intended to give a student a supportive space and to help a Parent notice when a child may be struggling. It is not counselling, therapy, diagnosis or an emergency service, and no doctor-patient or counsellor-client relationship is created by using it. Helpline numbers shown within the Platform belong to independent organisations with whom we have no affiliation. In an emergency, contact a qualified professional or the local emergency services immediately.
8. Prepaid Wallet, charges and billing
8.1 How the Wallet works
- BigGuruAI operates on a prepaid, pay-as-you-use model. There is no monthly subscription and no lock-in period.
- An Institute (or an independent Student) adds funds to its Wallet, either online through our payment gateway or by bank transfer to the Company's account, in which case we credit the Wallet on receipt.
- The full amount deposited is credited to the Wallet. We do not deduct any joining fee, platform fee or set-up fee from a deposit. Payment gateway charges, where applicable, are borne by the Company.
- Each chargeable action — such as a doubt answered, a hint, a test generated, a study plan or a mood check-in — deducts a fixed amount from the Wallet at the time it is used. Every deduction is recorded in a ledger visible to us and reportable to the Institute on request.
- All rates are inclusive of Goods and Services Tax at the applicable rate. The rate for each action is communicated to the Institute in writing before onboarding, and may be revised as set out in clause 8.2 below.
- A per-student monthly usage limit may be set so that no single student can consume a disproportionate share of an Institute's Wallet. The limit resets on the first day of each calendar month, Indian Standard Time.
8.2 Revision of rates
BigGuruAI runs on artificial intelligence, cloud infrastructure and telecommunication services bought from third parties. The cost of these inputs — AI processing, servers, messaging and the taxes on them — is set by those providers and by the Government, and changes from time to time without reference to us.
The Company may therefore revise the rate charged for any action on the Platform at any time and without prior notice. A revised rate applies to all usage from the moment it takes effect, including usage funded by an amount already lying in the Wallet. As our rates are inclusive of Goods and Services Tax, any change in the applicable rate of tax is reflected in them automatically. If a rate increases, an Institute may stop using the Platform and claim a refund of its unused Wallet balance. Amounts already consumed are not refundable.
8.3 When the balance runs low
The Institute dashboard shows the Wallet balance at all times, together with early warnings as the balance falls. When the Wallet balance is insufficient, chargeable features stop for that Institute's students until the Wallet is topped up. Previously generated answers, tests and plans remain readable. We are not liable for any interruption in study caused by an Institute allowing its Wallet to run empty, but we make reasonable efforts to warn it in advance.
8.4 Invoicing
A GST invoice is issued by the Company in respect of amounts received. It is the Institute's responsibility to give us its correct legal name, State and GSTIN, where it has one, so that the invoice is issued correctly.
9. Service delivery and activation
BigGuruAI is delivered entirely electronically. There is no physical product, and therefore no shipping or courier is involved.
- Access is activated on the Platform once the Institute has been onboarded and its student list has been uploaded — normally within two working days of receiving a complete and correct list.
- A Wallet top-up made online is normally credited to the Wallet within a few minutes of a successful payment, and chargeable features resume immediately thereafter.
- A top-up made by bank transfer is credited after the funds are received and identified, normally within one working day.
- The Platform is accessed at app.bigguruai.com from any modern browser on a mobile phone, tablet or computer. No installation is required.
If a payment succeeds but the Wallet is not credited, please write to contact@durvaai.com with the payment reference and we will resolve it. See our Refund & Cancellation Policy.
10. Availability and support
We aim to keep the Platform available at all times, but we do not guarantee uninterrupted availability. The Platform may be unavailable during planned maintenance, or because of failures at our hosting, AI or telecom providers, or because of events outside our reasonable control. We will make reasonable efforts to restore service promptly. Support requests may be sent to contact@durvaai.com.
11. Intellectual property
The BigGuruAI name, logo, interface, design, software, prompts and underlying systems are the property of Durva AI Private Limited and are protected by law. Nothing in these Terms transfers any ownership to an Institute or a user.
An Institute and its Students may use content generated for them on the Platform for their own study and internal teaching purposes. That content may not be resold, published as a commercial product, or presented as the work of another organisation.
12. Data protection
Our handling of personal data, including the additional protections we apply to children's data and to mood check-ins, is described in our Privacy Policy, which forms part of these Terms.
13. Suspension and termination
- An Institute may stop using the Platform at any time by writing to us. There is no notice period and no termination charge.
- We may suspend or terminate access where these Terms are breached, where the Wallet remains empty for a prolonged period, where we are required to do so by law, or where continued use would create a risk to other users.
- On termination, any unused Wallet balance is dealt with in accordance with our Refund & Cancellation Policy.
14. Limitation of liability
To the maximum extent permitted by law:
- the Platform is provided on an "as is" and "as available" basis, without warranties of any kind beyond those that cannot be excluded by law;
- we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, goodwill, opportunity, marks, rank or admission; and
- our total aggregate liability arising out of or in connection with the Platform shall not exceed the amount actually received by us from the Institute or user concerned in the three months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot be excluded under Indian law.
15. Indemnity
An Institute agrees to indemnify and hold the Company harmless against any claim, loss or expense arising from its breach of these Terms, from its failure to obtain parental consent before submitting a child's details, or from inaccurate information it has supplied to us.
16. Changes to these Terms
We may amend these Terms from time to time. The amended Terms will be published on this page with a new "last updated" date, and, where the change is material, we will inform the Institutes on record. Continued use of the Platform after that date constitutes acceptance of the amended Terms.
17. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at Churu, Rajasthan shall have exclusive jurisdiction over any dispute arising out of or in connection with them, subject to any right a consumer may have under applicable law.
